1. Acceptance of Terms

By accessing or using PetTailez, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service. These Terms constitute a legally binding agreement between you and PetTailez.

By creating an account, uploading content, or using any feature, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are creating a Business/Partner account, additional terms in Sections 22–34 apply.

2. Eligibility and Age Restrictions

• You must be at least 16 years old to use PetTailez
• Users aged 16–18 require parental or guardian consent
• Business/Partner accounts must be operated by individuals aged 18+ who are legally authorized to bind their business
• Users under 16 are strictly prohibited
• PetTailez reserves the right to request proof of age and business registration at any time

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Keeping your account information accurate and up-to-date
• Notifying us immediately of any unauthorized access to your account
• Using strong, unique passwords
• Not sharing your account with others

4. Service Description

PetTailez is a social media platform for pet owners and pet-related businesses, offering:

• Pet profile creation and management
• Photo and video uploading and sharing
• Commenting, liking, and social interactions
• Private and regional messaging
• GPS-based location tagging
• Optional boost services for increased visibility
• Partner business profiles and advertising

5. User Content and Intellectual Property

You retain full ownership of all content you upload to PetTailez. By posting content, you grant PetTailez a worldwide, non-exclusive, royalty-free license to display, reproduce, distribute, and create derivative works of your content solely for the purpose of operating and promoting the Service.

You may revoke this license by deleting your content or your account, though cached or archived copies may persist temporarily. You warrant that your content does not violate any third-party rights.

6. Prohibited Content and Conduct

You agree NOT to post:

• Hate speech, discrimination, or content promoting violence
• Sexually explicit or pornographic content
• Content promoting illegal activities, drugs, or weapons
• False, misleading, or fraudulent information
• Spam or unauthorized advertising
• Animal abuse or cruelty content
• Malicious code or viruses
• Harassment or bullying content
• Impersonation of other individuals or entities
• False location data
• Medical or veterinary advice from unlicensed individuals

Prohibited actions include:

• Using automated systems such as bots, scrapers, or crawlers
• Attempting unauthorized access to the Service
• Reverse engineering any part of the platform
• Creating multiple accounts to evade bans
• Commercial breeding without proper licensing

7. Content Moderation and Removal

PetTailez reserves the right to:

• Review and monitor all user-generated content
• Remove content that violates these Terms without prior notice
• Suspend or permanently ban accounts
• Remove content deemed inappropriate at our sole discretion
• Act on user reports of violations
• Delete inactive accounts
• Remove Partner accounts that receive consistent complaints

8. Advertising and Paid Features

Partner Boosts: Local pet businesses can purchase boosts for priority placement in the platform. Boosts are non-refundable and provide no guaranteed results.

Pet Owner Boosts: Individual users can increase the visibility of their pet content through boost purchases.

Sponsored Ads: Premium businesses can purchase targeted advertising campaigns.

9. Location Services and GPS Data

PetTailez uses GPS for tagging posts, regional messaging, and location-based features.

You must provide accurate location data if you choose to share it, and must not falsify GPS information. PetTailez is NOT responsible for any harm resulting from your location sharing decisions.

10. Data Storage and Third-Party Services

• Supabase: Database, authentication, user profiles, and messaging
• Cloudflare R2: Media storage and content delivery

All data is subject to third-party providers' terms and policies.

11. Privacy and Data Protection

• PetTailez complies with GDPR (EU), CCPA (California), and other applicable data protection laws
• We collect only necessary data for service operation
• You have rights to access, correct, delete, and export your data
• We do not sell personal data to third parties
• We implement industry-standard security measures
• Partners may have additional data retention requirements for tax/legal purposes

12. User Reports and Community Standards

Users can report inappropriate content, harassment, fake accounts, animal abuse, unlicensed advice, and Partner violations. PetTailez reviews all reports and may remove content, warn, suspend, or terminate accounts accordingly. False reports may result in penalties against the reporting user.

13. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

PetTailez is NOT liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or use
• Service interruptions or outages
• Unauthorized access or data breaches
• User interactions or user-generated content
• Pet injuries resulting from location features or meetups
• Inaccurate user or Partner information
• Third-party actions
• Partner service quality or legality
• Medical outcomes from veterinary advice on the platform
• Theft or injury from in-person meetings
• Advertising results or campaign performance
• Breeding arrangements or pet sales

MAXIMUM LIABILITY: The amount you paid to PetTailez in the past 12 months or €100, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless PetTailez and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violations of these Terms, violations of third-party rights, your content, your interactions with other users, use of Partner services, or in-person meetings arranged through the platform.

15. International Use and Governing Law

• Your data may be transferred between countries as part of service operation
• You are responsible for complying with your local laws
• These Terms are governed by the laws of the Republic of Serbia
• EU users retain all mandatory consumer protection rights under applicable EU law
• California users retain all CCPA rights

16. Changes to Terms

PetTailez may update these Terms at any time. Changes are effective immediately for new users. Existing users will receive 30 days notice before material changes take effect. Material changes require explicit acceptance from Partner accounts.

17. Account Termination and Data Deletion

You may delete your account at any time through the app settings or by contacting support@pettailez.com.

Upon account deletion:

• Your profile will be removed from public view immediately
• Some data may be retained for legal and security purposes for up to 90 days
• Any unused credits or boosts will be forfeited
• You can request complete data deletion by emailing support@pettailez.com with the subject "Account Deletion Request"

PetTailez may terminate your account if you violate these Terms, engage in fraud, violate applicable laws, receive multiple complaints, or if we discontinue the Service.

18. Dispute Resolution

For any disputes, please first contact us at support@pettailez.com for informal resolution. We will respond within 14 business days. If informal resolution is not possible, disputes may be subject to binding arbitration. Class action waiver applies except where prohibited by applicable law.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary to make it valid while maintaining the original intent. All other provisions remain in full force and effect.

20. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and PetTailez. regarding the use of the Service.

Additional Terms for Business Partners

The following sections (22–34) apply specifically to users operating Business or Partner accounts on PetTailez.

22. Business and Partner Account Responsibilities

Partners must:

• Be legally registered businesses or authorized sole proprietors
• Possess all necessary licenses, permits, and certifications
• Maintain current business registration
• Be authorized to bind the business to these Terms
• Keep all business information accurate and current
• Notify PetTailez of any license suspensions or revocations
• Maintain adequate liability insurance
• Comply with all applicable regulations
• Respond to customer inquiries professionally
• Honor prices and promises made on the platform

PetTailez may request business registration documents, tax IDs, professional licenses, insurance certificates, and health/safety certifications at any time.

Partners are prohibited from:

• Operating without proper licenses
• Selling illegal or counterfeit products
• Providing unlicensed veterinary services
• Misrepresenting qualifications or credentials
• Operating pyramid schemes
• Using the platform for illegal business purposes

23. Performance and Marketing Disclaimers

Partners are responsible for creating high-quality, compelling content, accurate targeting, competitive pricing, professional presentation, and compliance with all advertising regulations.

24. Product and Service Liability

PETTAILEZ IS ONLY A PLATFORM — NOT A PARTY TO ANY TRANSACTIONS

PetTailez is not a party to any transaction between Partners and users, is not responsible for the quality, safety, legality, or accuracy of any products or services, does not endorse or guarantee any Partner, and is not liable for any business disputes.

Partners are solely responsible for product quality and safety, consumer protection compliance, product recalls, accurate descriptions, service delivery quality, proper training and facilities, customer service, all legal compliance, insurance coverage, and any harm resulting from their products or services.

25. Medical and Veterinary Advice Prohibition

Unless you are a licensed veterinarian, it is strictly prohibited to provide medical diagnosis, medication or treatment recommendations, veterinary advice in comments or messages, home remedies for medical conditions, or to make claims about curing or treating diseases.

Licensed veterinarians must verify their credentials, comply with telemedicine laws, maintain liability insurance, and establish a proper VCPR before giving specific advice. General educational content is permitted.

Acceptable content includes general care tips, veterinary visit recommendations, personal experiences clearly labeled as such, and educational content with appropriate disclaimers.

PETTAILEZ IS NOT RESPONSIBLE for any medical advice, outcomes, misdiagnosis, delayed care, or illness, injury, or death resulting from advice given on the platform.

26. Pet Safety and GPS Location Warnings

We strongly recommend: Use approximate locations (neighborhood or city), never post your exact home address, vary walking routes and times, disable GPS for home photos, post content after leaving the location, and review privacy settings regularly.

PetTailez provides location precision options and sharing controls, but does NOT monitor your sharing choices, warn you each time a location is shared, take responsibility for your decisions, or guarantee your safety. You are solely responsible for your location sharing decisions and all consequences.

27. Breeding, Sales, and Adoption Restrictions

The following are strictly prohibited:

• Commercial animal sales
• Advertising puppies or kittens for sale
• Facilitating breeding arrangements for profit
• "Puppy mills" or irresponsible breeding operations
• Selling exotic or endangered species
• Selling animals without proper permits
• Stud services or breeding contracts via private messages

Permitted activities include:

• Sharing your own pet photos and stories
• Responsible pet ownership discussion
• Educational breed and training content
• Licensed shelter and rescue promotion
• Licensed breeders with verified Partner accounts (no direct animal sales on platform)

Licensed shelters and registered rescues may promote adoptable pets through verified accounts. All adoptions must be completed through proper legal channels outside the platform. No private "rehoming" arrangements are permitted.

Accounts found conducting sales will be immediately banned. Suspected trafficking will be reported to the authorities.

28. In-Person Meetings and User Safety

If you choose to meet someone: Tell a friend or family member where you are going, who you are meeting, and when; share the person's profile with someone you trust; research the person online; trust your instincts and cancel if uncomfortable; verify identity via video call first.

Meeting location: ALWAYS meet in a public place. NEVER invite strangers to your home or go to a stranger's home. Choose well-lit, populated areas. Avoid isolated locations.

During the meeting: Bring a friend if possible. Keep your phone charged. Don't share personal or financial information. Don't leave your pet unattended with strangers. Leave if you feel uncomfortable.

Minors: Must NEVER meet anyone from the app without a parent or guardian present. Parents are responsible for supervision.

PETTAILEZ IS NOT RESPONSIBLE for any harm, injury, assault, crime, pet theft, fraud, scams, or any outcomes of offline interactions.

29. Partner Verification and Licensing

Partners must provide their business name, registration number, and contact details. Enhanced verification may include business registration documents, professional licenses, insurance certificates, and tax documentation.

What verification means: We have reviewed the submitted documentation. Verification does NOT guarantee quality, reliability, or trustworthiness. It does NOT mean we endorse the business. It only confirms that documentation was provided.

Industry-specific requirements:

• Veterinary Services: Current veterinary license, professional liability insurance, telemedicine law compliance
• Pet Food/Supplement Sellers: Food safety law compliance, accurate labeling, ingredient and allergen listing
• Boarding/Daycare: Appropriate business licenses, liability insurance, local zoning and health compliance
• Groomers/Trainers: Relevant certifications (encouraged), safe facilities and equipment

False information will result in immediate suspension or termination, forfeited advertising credits, potential reporting to authorities, and legal action for fraud.

30. Review System and Content Authenticity

Permitted: Honest reviews from genuine experiences, fair product and service criticism, balanced feedback, and factual descriptions.

Prohibited: Fake or fabricated reviews, reviewing businesses not used, paying for positive reviews, negative reviews to harm competitors, review bombing, and creating fake accounts for self-reviews.

Partners must not: Offer discounts for positive reviews, pay for fake reviews, create fake accounts for their own business, solicit undisclosed friend/family reviews, threaten users for negative reviews, or post fake negative reviews of competitors.

All photos and content must represent actual products and services. Before/after photos must be real and not manipulated. Testimonials must be from real customers. Stock photos must not be represented as original work.

31. Anti-Discrimination Policy for Partners

All Partners must provide equal service regardless of race, ethnicity, national origin, religion or belief, gender or gender identity, sexual orientation, age, disability, marital or family status, pregnancy or parental status, or any other legally protected characteristic.

Permitted distinctions: Specializing in certain pet types or breeds, declining services based on legitimate safety or behavioral reasons, setting reasonable pet policies (size, age, vaccinations), and refusing service to abusive or threatening customers.

Confirmed discrimination will result in immediate account termination and may be reported to the appropriate authorities.

32. Illegal Activities and Wildlife Trade Prohibition

ZERO TOLERANCE FOR ILLEGAL ACTIVITIES

The following are absolutely prohibited:

• Selling, trading, or promoting endangered species or illegal wildlife (CITES violations)
• Any content related to animal fighting (dog fighting, cock fighting, etc.)
• Animal abuse, neglect, or cruelty content
• Selling controlled substances, illegal drugs, prescription medications without licensing, counterfeit or stolen goods
• Scams, fake fundraising, fake rescue operations, ponzi/pyramid schemes, identity theft
• Unlicensed veterinary practice, unlicensed boarding facilities, or unlicensed businesses

PetTailez will report suspected illegal activities to law enforcement, wildlife protection agencies, animal welfare organizations, and regulatory authorities. Violations result in immediate permanent bans and evidence preservation for legal proceedings.

33. Tax, Insurance, and Legal Compliance

Partners are solely responsible for all tax obligations including business income taxes, sales tax/VAT collection and remittance, payroll taxes, and self-employment taxes. PetTailez does NOT withhold taxes, provide tax advice, or act as an employer.

Recommended insurance: General liability insurance, professional liability insurance (for service providers), product liability insurance (for sellers), property insurance (for facilities), and industry-specific coverage such as veterinary malpractice insurance, bailee insurance for boarding/daycare, grooming injury coverage, and care/custody/control coverage for dog walkers.

Partners must comply with all local business licensing, zoning regulations, health and safety codes, industry-specific regulations, consumer protection laws, employment laws, data protection laws, and advertising regulations. PetTailez may terminate accounts for legal non-compliance.

34. Liability Release and Assumption of Risk

COMPREHENSIVE LIABILITY RELEASE

By using PetTailez, you explicitly acknowledge that PetTailez is only a platform and not a party to any interactions or transactions. We provide no products or services ourselves. We do not guarantee, warrant, or endorse any user, Partner, content, product, or service.

You assume all risks from user interactions, in-person meetings, Partner purchases and services, following platform advice or recommendations, sharing location data or personal information, breeding arrangements, adoptions, pet transactions, platform events or meetups, and any other PetTailez-connected activities.

To the maximum extent allowed by law, you release, waive, and discharge PetTailez and all associated parties from any liability for personal harm, pet-related harm, financial loss, property damage, quality issues, data and privacy issues, and any and all other claims of any kind.

Maximum Liability: Despite this release, if PetTailez is found liable, our total liability is limited to the amount you paid in the past 12 months or €100, whichever is greater.
